Please read these terms carefully before using BitCare.

1 Acceptance of Terms
By using BitCare, you agree to these Terms of Service. If you do not agree, please do not use the application.
Age Requirement: You must be at least 18 years of age to use BitCare. By using the service, you represent and warrant that you meet this age requirement.
2 Description of Service
BitCare is a digital planning and documentation platform designed to assist users in organizing their Bitcoin self-custody and continuity plans. BitCare does not hold, control, or manage digital assets and does not act as a custodian, executor, trustee, or fiduciary.
BitCare helps you understand, structure, and document how you care for your digital assets - without taking control. The service includes readiness assessments, educational resources, custody strategy tools, and legacy planning features.
BitCare cannot guarantee that digital assets can be recovered based on the information stored by the user.
Important: All content is informational only and does not constitute financial, legal, or investment advice. BitCare operates on a strictly non-custodial basis. We never request or store private keys, recovery phrases, passwords, or account balances.
No Financial Advice: BitCare is an educational and organizational tool only. Nothing in the service should be construed as financial, investment, tax, or legal advice. You should consult qualified professionals before making any decisions regarding your digital assets.
3 User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You remain solely responsible for the custody, storage, and transfer of any digital assets.
You agree to provide accurate, current, and complete information during registration and to update such information as needed.
Consent to Electronic Communications: By creating an account, you consent to receive electronic communications from BitCare, including service announcements, administrative messages, and updates to these Terms. You may opt out of non-essential communications at any time through your account settings.
4 Acceptable Use
You agree to use BitCare only for lawful purposes and in accordance with these Terms. You may not:
- Use the service to transmit harmful, offensive, or illegal content
- Attempt unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the operation of the service
- Reverse engineer or attempt to extract source code from the application
- Use the service for any commercial purpose without our consent
- Store private keys, seed phrases, or other cryptographic secrets in any BitCare fields
- Use automated systems, bots, scrapers, or other tools to extract data from the service
- Attempt to circumvent any security measures or access controls
5 Legacy Planning Feature
BitCare offers a Legacy Planning feature that allows users to document instructions intended to help beneficiaries understand how digital assets are organized. These instructions are informational and organizational in nature only.
- Legacy plans are for documentation and instructional purposes only
- You must never enter seed phrases, private keys, passwords, or other secrets in legacy plan fields
- BitCare is not responsible for the accuracy, completeness, or execution of your legacy plans
- Legacy plans do not constitute legal documents such as wills, trusts, or estate instruments
- You should consult qualified legal and financial professionals for estate planning
- You are responsible for keeping exported legacy plan documents secure
Security Notice: BitCare does not store or transmit cryptographic secrets. By using the Legacy Planning feature, you confirm that you will not enter any private keys, seed phrases, or critical credentials into any field within the application.
Executor Access: In the event of a user's death, BitCare may, at its sole discretion and after reasonable administrative verification, provide access to legacy documentation or instructions to a person claiming to be an executor, beneficiary, or trusted contact. BitCare does not determine legal inheritance rights and does not guarantee the legitimacy of any requesting party.
6 Post-Death Data Requests
BitCare may receive requests from individuals claiming to represent a deceased user. Such requests may include executors, heirs, or family members seeking access to documentation created within the BitCare platform.
BitCare may request reasonable documentation in order to process such requests, which may include:
- Death certificate or similar official documentation
- Government identification of the requesting party
- Executor appointment documentation or proof of relationship where available
BitCare performs administrative review only. BitCare does not verify legal inheritance rights, does not act as a court, and does not determine the rightful owner of any digital assets.
BitCare reserves the right to refuse or delay any request if documentation is incomplete, inconsistent, or raises reasonable concerns regarding legitimacy.
Important: BitCare does not have access to user wallets, private keys, seed phrases, or digital assets. BitCare cannot transfer, recover, or control digital assets under any circumstances.
7 Intellectual Property
The BitCare application, including its design, features, and content, is owned by BitCare and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Documents and data you create within BitCare remain your property. We claim no ownership over your personal content, including assessments, strategies, recovery plans, and legacy plans.
8 Privacy and Data Rights
Your use of BitCare is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
You have the right to export your data, delete your account, and withdraw consent at any time. For data access requests, contact support@bitcare.app.
9 Disclaimers
BitCare is provided "as is" without warranties of any kind, express or implied. We use industry-standard security practices, but cannot guarantee that no vulnerabilities exist or that the service will be uninterrupted or error-free.
Educational Purpose Only: BitCare provides educational information about digital asset custody. It is not a substitute for professional financial, legal, or security advice.
No Custody Services: BitCare does not hold, manage, or have access to your digital assets. We cannot recover lost assets, execute transactions, or access your wallets under any circumstances.
10 Limitation of Liability
To the fullest extent permitted by law, BitCare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of digital assets, data, or profits.
You agree to indemnify and hold BitCare harmless against any claims, disputes, or legal proceedings arising from inheritance matters or access to digital asset instructions stored within the platform.
Our total liability to any individual user for any claim arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or CHF 100, whichever is greater.
11 Subscription and Billing
Some features of BitCare require a paid subscription. Subscription terms, pricing, and billing cycles are presented at the time of purchase.
Recurring Subscriptions: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
Cancellation: You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period.
Refunds: Refunds are handled in accordance with the policies of the platform through which you subscribed (Apple App Store or Google Play Store). BitCare does not process refunds directly.
12 Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify users of significant changes and provide the ability to export your data before discontinuation.
13 Termination
We may terminate or suspend your account if you violate these Terms. You may delete your account at any time through the app settings, which will permanently remove all your data from our systems.
14 Governing Law and Dispute Resolution
These Terms are governed by the laws of Switzerland. In the event of any dispute, you agree to first attempt to resolve it informally by contacting us at support@bitcare.app. Unresolved disputes shall be handled exclusively in the courts of Canton Schwyz, Switzerland.
15 Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the service after changes take effect constitutes acceptance of the new Terms.
